Scotts Expands Wild Bird Suet Recall

Posted: Friday, March 20, 2009, 5:41 p.m., EDT

The Scotts Co. LLC of Marysville, Ohio, expanded on March 20 its voluntary wild bird food suet recall to include five additional varieties and additional manufacturing date codes (from May 13, 2008 to Feb. 8, 2009)  from its initial recall in mid-February.

The newly recalled products may contain peanut meal from the Peanut Corp. of America’s facilities in Texas or Virginia and could be contaminated with Salmonella, Scotts reported. The initial recall focuses on products with peanut mill from the PCA’s Georgia plant.

As a result of the recall, Scotts said it has severed its relationship with the broker that supplied the peanut mill and has filed a lawsuit against the broker.

The Scotts Co. reported that it has still received no reports of illness, but people handling contaminated birdseed could become infected with Salmonella, especially if they do not wash their hands thoroughly after handling the products.

The company requested that retailers and distributors remove recalled products from their shelves and warehouses and return them to The Scotts Co.

The Scotts Co. also asked those parties to advise their consumers about the risk and tell them to discard affected products and wash their hands thoroughly.

Consumers can contact The Scotts Co. at 866-512-8876  to arrange for replacement products or refunds.

Newly recalled products are:

"New troubles for the company at the center of the nation’s salmonella scare have prompted Scotts Miracle-Gro Co. to expand its recall of wild bird food products.

"Scotts Co. LLC, a subsidiary of the Marysville-based lawn and garden giant, on Friday added seven products to the slate of suet wild bird food it recalled in February over concerns they might contain peanut meal bought from Lynchburg, Va.-based Peanut Corp. of America.

"Scotts also said Friday it has severed ties with Mount Prospect, Ill.-based Cereal Byproducts Co., the broker that supplied Peanut Corp. of America peanut meal that sparked the recall. The company in February sued Cereal Byproducts, claiming breach of contract and negligent misrepresentation and alleging it gave Scotts false information about the origins of its products."

Peanut recall triggers Scotts lawsuit

"Scotts Miracle-Gro Co. is suing a supplier to reclaim the Marysville company’s peanut-related recall costs.

"The lawn-and-garden products maker filed the lawsuit against Mount Prospect, Ill.-based Cereal Byproducts Co., claiming breach of contract and negligent misrepresentation and alleging it gave Scotts false information about the origins of its products.

"Scotts is seeking unspecified damages, but said it expects to incur expenses of more than $75,000 for the purchase of products, recall costs, lost profits and injury to goodwill.

"Scotts (NYSE:SMG) filed the suit Tuesday in U.S. District Court in Columbus, the same day it issued a recall for five varieties of suet wild bird food over concerns they might contain peanut meal bought from Peanut Corp. of America’s plant in Blakely, Ga. The products of Peanut Corp., which has filed for bankruptcy, are at the epicenter of a federal probe into a salmonella outbreak that has involved scores of illnesses and several deaths, including two in Ohio.

"Scotts alleges that Cereal Byproducts repeatedly told it the peanut by-products didn’t come from the Blakely facility, according to the lawsuit. It also alleged the company didn’t inform Scotts of a potential contamination until early this month, well after peanut butter recalls had begun and after Scotts produced the bird food and shipped it to retailers."

Cereal Byproducts Company Announces the Voluntary Nationwide Recall of Rice Protein Concentrate Produced in China

FOR IMMEDIATE RELEASE -- Mt. Prospect, Illinois -- May 4, 2007 -- Cereal Byproducts Company is announcing today that the FDA has determined that there are melamine and/or melamine derivatives in the rice protein concentrate produced by a single source Chinese supplier, Binzhou Futian Biology Technology Co. Ltd., and purchased through a local domestic importer. Cereal Byproducts shipped the recalled product to a total of three customers located in the Midwest between July 19, 2006 and March 14, 2007. The FDA previously found melamine and/or melamine derivatives in Wilbur-Ellis Company's rice protein concentrate, which was purchased from the same Chinese supplier as Cereal Byproducts. Cereal Byproducts proactively notified their customers of this finding, and thereafter both parties implemented their own voluntary recall of the contaminated products on or about April 19, 2007.

Although Cereal Byproducts has received no confirmed cases of pet deaths, it voluntarily chose to initiate the recall when Cereal Byproducts discovered there was a potential contamination of melamine or melamine type derivatives in the rice protein. We are confident that our customers have implemented on-going recalls and the remaining rice protein concentrate, not previously distributed to these customers, is located at a separate warehouse facility under quarantine.

JustMe,
There is a phone number in the announcement.  Perhaps you can call and they can tell you if your treats were manufacturered after the date of the recall and are safe.
